Los Angeles – Katie Holmes’ lawyer has denied claims that the actress filed for an emergency custody hearing in New York, reports .

claimed that Katie, who is divorcing Tom Cruise after five years of marriage, requested an “emergent application” in New York City court on Tuesday to determine immediate custody and child support issues over the couple’s six-year-old daughter, Suri.

Katie’s lawyer Jonathan Wolfe told People: “Other than her action for divorce, the only pending application filed by Ms Holmes remains her request for an anonymous caption.”

This request is to ensure that all papers regarding this matter are filed anonymously.

Tom Cruise is yet to file any legal papers. He spent his 50th birthday, which he celebrated on Tuesday, with his older children Isabella and Connor.
