Kenya: Deportation of Chinese Nationals Suspended

An order to deport four Chinese nationals, who were arrested in connection with the assault of a Kenyan employee, has been suspended by the Nairobi High Court.

In video footage that emerged online earlier this month, chef Deng Hailan is seen caning a Kenyan waiter – who reportedly arrived late at work – outside the Chez Wou Restaurant in Kileleshwa, Nairobi.

Deng was soon arrested and charged with assault. Three Chinese restaurant employees – Chang Yueping, Ou Qiang and Yu Ling – were also arrested for working in the country on expired visas and without work permits.

Last Thursday, 13 February, Fred Matiang’i – the Interior Cabinet Secretary – reportedly ordered the four accused to be deported to China, after a court had allowed the authorities to detain them for another 15 days

However, Justice Luka Kimaru of the Nairobi High Court halted Matiang’i’s order yesterday, Wednesday 19 February, after the accused filed a petition challenging the deportation.

Justice Kimaru gave the office of the Directorate of Public Prosecution until this Friday, 21 February, to file responses to the petition.
