Embattled Kenyan Top Judge Fights Allegations

Kenya’s embattled Deputy Chief Justice, Philomena Mwilu, has filed an application seeking to stop the criminal prosecution against her following allegations of corruption.

In the application filed at the High Court on Wednesday, Judge Mwilu argues that the allegations rising from suspect handling of Imperial Bank cases are unfounded.

She was arrested at the Supreme Court in Nairobi on Tuesday morning, 28 August. The Director of Public Prosecutions (DPP), Noordin Haji, and criminal investigations head, George Kinoti, both arrived at her office to escort her away for questioning.

The arrest of such a high-ranking judicial staff member is unprecedented in Kenya’s history. The incident comes at a time of investigations into overt corruption in the country’s judiciary system, and is likely to send shockwaves throughout the institution.

Judge Mwilu says the allegations that Mr Haji has brought forward against her are malicious and have nothing to do with the pursuit of criminal justice.
